Global terms for the Foremates app and website

These Terms govern use of the Foremates mobile application, website and related consumer services. They are intended to work globally, subject to mandatory rights that apply in your country.

1. Who we are

Foremates is a product and trading brand operated by Luduslabs Ltd, a private limited company incorporated in England and Wales under company number 16312935, with registered office at 132 Kennel Lane, Billericay, England, CM11 2SU (“Luduslabs”, “Foremates”, “we”, “us”, “our”).

2. Scope of these Terms

These Terms apply when you access or use the Foremates app, website or related consumer-facing services (the “Service”). By creating an account or using the Service, you agree to these Terms.

If a golf club, company, event organiser or other organisation buys Foremates under a separate order form or business agreement, that organisation’s use of the business service is also governed by the applicable Foremates business agreement. If there is a conflict, the signed business agreement governs that organisation’s business use.

Our Privacy Policy explains how we handle personal data. It forms part of the information you should read before using the Service.

3. Eligibility

You must be at least 13 years old to create a Foremates account. If the law where you live requires parental or guardian consent for a person of your age to use an online service or for us to process personal data, you must have that consent.

The Service is not directed to children under 13. We may take reasonable steps to verify age or consent where required by law.

4. Your account

You must provide accurate information, keep your login details secure and promptly tell us if you believe your account has been compromised.

You are responsible for activity carried out through your account unless caused by our breach of these Terms or our security obligations.

You may not sell, transfer or share an account in a way that defeats our access controls.

5. The Foremates Service

Foremates helps golfers, groups, clubs and organisers plan and run golf activities. Features may include games, tournaments, events, invitations, registration, tee sheets, scoring, leaderboards, statistics, messaging, groups, media, payments, club tools and AI-enabled features.

Features may change over time as we improve the Service. We may add, modify or retire features, provided we do not materially reduce a paid service during a committed subscription period without a reasonable basis or an alternative remedy where required by law.

6. Licence to use the App

Subject to these Terms, Luduslabs grants you a personal, limited, revocable, non-exclusive, non-transferable licence to download, install and use the Foremates app on devices you own or control, in accordance with the rules of the relevant app store.

You may not copy, modify, distribute, sell, lease, reverse engineer or attempt to extract source code from the Service except to the extent that applicable law expressly permits this despite this restriction.

7. User content and community features

You retain ownership of photos, posts, messages, comments, scorecards and other content you submit (“User Content”).

You grant Luduslabs a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, transmit, adapt for technical purposes and otherwise use User Content only as reasonably necessary to provide, secure, improve and support the Service and, where you have made content public, to display it within Foremates.

You must not upload or share content that is unlawful, fraudulent, defamatory, threatening, harassing, hateful, sexually explicit, exploitative, invasive of privacy, infringing, deceptive, malicious or otherwise harmful.

Foremates may provide tools to report content or users and to block users. We may investigate reports, remove content, restrict visibility, suspend accounts or take other proportionate action. We may preserve evidence or disclose information where required by law.

You must have the rights and permissions needed for content you submit, including images of other people.

8. Golf, scoring and handicap information

Scoring, statistics, handicaps, course data, distances and competition information may depend on information supplied by users, clubs or third parties. You are responsible for checking official competition rules, local rules and handicap requirements where accuracy matters.

Unless we expressly state otherwise, Foremates is not an official handicap authority and information shown in the Service does not replace an official handicap index or governing-body record.

9. AI-enabled features

Some Foremates features may use artificial intelligence to help create, organise, summarise, analyse or suggest content. AI-generated output can be inaccurate, incomplete or unsuitable.

You remain responsible for reviewing AI output before relying on it, especially for competition setup, rules, safety, financial, legal or other important decisions. Do not submit information to an AI feature that you are not permitted to share.

We will explain material uses of personal data by AI-enabled features in our Privacy Policy and, where required, obtain appropriate permission before sharing personal data with third-party AI providers.

10. Payments and subscriptions

Consumer subscriptions may be purchased through the Apple App Store or Google Play. Store purchases are billed and managed by the relevant store and are also subject to its terms.

Subscriptions may renew automatically unless cancelled through the relevant store before renewal. Prices, billing periods and renewal terms are shown before purchase.

Refunds for store purchases are handled under the relevant store’s rules and any rights you have under applicable consumer law.

Deleting the Foremates app or your Foremates account does not necessarily cancel a store subscription. You should cancel the subscription separately through Apple or Google.

11. Society and event payments

Foremates may allow a society, club or organiser to request or collect payments such as green fees, event fees or subscriptions. Payment processing may be provided by Stripe or another disclosed payment provider.

Unless Foremates expressly acts as merchant of record for a particular transaction, the society, club or organiser is responsible for the underlying charge, refund entitlement and goods or services being purchased. Foremates may charge a separately disclosed platform fee.

We do not store full payment-card details when they are collected directly by the payment provider.

12. Acceptable use

You must not:

• break the law or infringe another person’s rights;
• harass, threaten, abuse or impersonate another person;
• upload malware or harmful code;
• attempt unauthorised access to accounts, systems or data;
• probe, scan or test vulnerabilities without written permission;
• scrape, crawl or use automated access in breach of our instructions or applicable law;
• interfere with the security, integrity or performance of the Service;
• use the Service to send spam or unsolicited commercial messages;
• misuse competitions, scoring, payments or identity features for fraud; or
• use the Service or AI features to create or distribute prohibited or harmful content.

We may take reasonable steps to prevent abuse and protect users, customers and the Service.

13. Intellectual property

The Service, software, designs, branding, databases and other materials supplied by Foremates are owned by Luduslabs or its licensors and are protected by intellectual-property laws.

Except for the limited licence in these Terms, no rights are transferred to you.

“Foremates” and associated branding may not be used in a way that suggests sponsorship, endorsement or affiliation without permission.

14. Third-party services

The Service may integrate with or link to third-party services such as app stores, authentication providers, payment providers, golf-data providers and mapping or analytics services.

Third-party services are governed by their own terms and privacy practices. We are not responsible for third-party services outside our control, but we remain responsible for our own obligations under applicable law.

15. Service changes, suspension and termination

You may stop using the Service at any time and may delete your account as described at foremates.com/account-deletion.

We may suspend or terminate access where reasonably necessary because of a serious or repeated breach, fraud, security risk, legal requirement, non-payment of an applicable direct Foremates charge, or conduct that materially harms the Service or other users.

Where appropriate, we will give notice and a reasonable opportunity to remedy the issue.

Terms that by their nature should continue after termination, including intellectual property, liability and dispute provisions, remain in effect.

16. Disclaimers

We provide the Service with reasonable care and skill. However, internet and mobile services can experience interruptions and third-party data can be inaccurate.

To the extent permitted by law, we do not promise that the Service will always be uninterrupted, error-free or compatible with every device, course, event format or third-party system.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

17. Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

If you use Foremates as a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. We are not responsible for business losses arising from consumer use.

To the extent permitted by law, we are not responsible for losses caused solely by information you or a third party supplied, events outside our reasonable control, or use of the Service contrary to these Terms or our reasonable instructions.

Any separate business agreement with a club or organisation contains its own liability provisions for business use.

18. Consumer rights

These Terms do not remove mandatory consumer rights available to you under the law of your country or state. If a local law gives you rights that cannot be waived by contract, those rights continue to apply.

19. International use and export controls

Foremates is operated from the United Kingdom and may be used in multiple countries. You are responsible for using the Service lawfully where you are located.

You must not use or export the Service in breach of applicable trade sanctions, export-control laws or restrictions applying to you or Luduslabs.

20. Apple App Store terms

Where you obtain the App through Apple:

• these Terms are between you and Luduslabs, not Apple;
• Apple is not responsible for the App, its content, maintenance or support;
• your licence is limited to use on Apple-branded products you own or control as permitted by Apple’s usage rules and applicable family-sharing or volume-purchase rules;
• if the App fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any, as provided by Apple; to the maximum extent permitted by law Apple has no other warranty obligation;
• Luduslabs, not Apple, is responsible for addressing claims relating to the App, including product-liability, legal-compliance and intellectual-property claims; and
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions.

Apple’s standard end-user licence agreement applies to the App where we have not submitted a custom Apple EULA. These Foremates Terms govern the Service relationship alongside the applicable Apple licence terms.

21. Google Play terms

Where you obtain the App through Google Play, your use of Google Play and any store-managed purchases is also subject to Google Play’s applicable terms. Luduslabs remains responsible for the Foremates Service and support unless the relevant Google terms state otherwise.

22. Changes to these Terms

We may update these Terms to reflect changes to the Service, law, security requirements or our business. If a change materially affects your rights, we will provide reasonable notice where required.

Changes do not retroactively reduce rights already accrued before they take effect.

23. Governing law and disputes

These Terms are governed by the laws of England and Wales.

If you are a consumer, this choice does not deprive you of mandatory protections under the law of your country of residence, and you may have the right to bring proceedings in local courts.

If you are not a consumer and no separate business agreement applies, the courts of England and Wales have exclusive jurisdiction.
